The past decade has witnessed an unprecedented and rapid pace of federal policy making intended to achieve interoperability of core electronic health record (EHR) data. This movement began in 2009 with the interoperability requirements in the EHR incentive programs—which were weak at first but ramped up over time, so much so that the program was renamed Promoting Interoperability Program in 2018. It continued with the many regulations, frameworks, and programs stemming from the 21st Century Cures Act that became law in 2016. Today, it often feels that these federal policies are the only game in town. However, policy is a blunt instrument and is most effective when aimed at creating the conditions in which market forces can function more effectively.
