On October 24, 2024 the Centers for Medicare & Medicaid Services (CMS) released its draft Notice of Benefit & Payment Parameters (NBPP) for plan year 2026. This annual regulation, referred to informally as the “Payment Rule” or “Payment Notice,” prescribes standards and rules that govern insurers and health insurance Marketplaces under the Patient Protection & Affordable Care Act (ACA).

In addition to the draft Payment Notice, CMS released a fact sheet and draft 2026 Letter to Issuers. Comments on the proposed Payment Notice are due within 30 days of its publication in the Federal Register, and comments on the draft Letter to Issuers are due on November 4, 2024.
