Squeaking in right before the end of 2023, the Office for Civil Rights delivered some bad news to Optum Medical Care of New Jersey (formerly an independent physician practice) on the HIPAA. The bad news took the form of a settlement involving delaying access to medical records.

The Settlement Details

The settlement with Optum Medical Care of New Jersey (“OMCNJ”) was announced on December 15, 2023. As noted by OCR, in the Fall of 2021 six different complaints were submitted, each of which alleged that OMCNJ did not provide requested medical records. The records requested were either about the requesting individuals themselves or on behalf of the requesting individual’s minor child. The series of complaints came pretty quick and furious....
