In today’s column, I lay out a comprehensive set of policy considerations regarding regulating AI that provides mental health guidance. This is an important look at the range and depth of policies that ought to be given due consideration.

Please know that there are new laws being rapidly enacted at the state level that are pursuing a hit-or-miss approach to regulating AI in the realm of mental health. They are hit-or-miss in the sense that they tend to cover only a subset of the full range of policy aspects that need to be addressed. The resulting laws omit considerations that then leave regulatory gaps and create confusion over intentions about those unspecified conditions.
