On October 1, 2024, the Consumer Financial Protection Bureau (CFPB) issued an advisory opinion titled Debt Collection Practices (Regulation F); Deceptive and Unfair Collection of Medical Debt. The advisory opinion clarifies key provisions of the Fair Debt Collection Practices Act (FDCPA) and is intended to remind debt collectors of their obligations relating to medical debt. However, some debt collectors cried foul and quickly filed a lawsuit asserting that the agency engaged in improper rulemaking.

When announcing its advisory opinion, the CFPB noted that about 100 million Americans are carrying more than $220 billion in medical debt, and medical bills can be confusing and inaccurate. People have submitted complaints to the agency about receiving collections notices for debts they do not...
