On April 12, 2023, the Office for Civil Rights pre-released a notice of proposed rule-making that would modify the HIPAA Privacy Rule in direct response to mounting concerns about reproductive health services following the Supreme Court’s Dobbs decision. The proposed rule will introduce concepts specific to reproductive health into the Privacy Rule.

Specifics of the Proposed Rule

The proposed rule can be broken into a few major components. First, it would define reproductive health, then change the general rules around uses and disclosures of protected health information, and finally insert new limitations and requirements for uses and disclosures that do not require an opportunity to agree or object.
