Medicare Advantage (MA) enrollment has become the dominant delivery system for individuals who qualify for Medicare, with 51 percent of individuals enrolled as of 2023 (and an expected penetration of 60 percent penetration by 2030). A key feature of MA is its reliance on paid brokers and agents to enable enrollment in the program. These agents and brokers receive payments for every individual they enroll into an MA plan. While these payments are supposed to be standard across the industry, some plans have found creative ways to enhance them.

Because of this arrangement, brokers and agents have the perverse incentive to encourage individuals to switch—both from traditional Medicare and between MA plans. The Centers for Medicare and Medicaid Services (CMS)...
