Earlier this year, the U.S. Department of Health and Human Services (HHS) issued a final rule that aims to enhance care coordination for people with substance use disorder (SUD). The final rule modifies the Confidentiality of SUD Patient Records regulations under Title 42 of the Code of Federal Regulations (42 CFR part 2, commonly known as “Part 2”) by granting greater information-sharing flexibilities among applicable providers and simplifying SUD record-keeping. It also strengthens compliance standards and preserves the previous requirement that SUD records not be used in criminal or civil proceedings without consent or a court order.
