On August 29th, 2024, TrueCoverage, LLC (TrueCoverage) and Benefitalign LLC (Benefitalign), two online entities supporting enrollment in the Affordable Care Act (ACA) Marketplaces, sued the U.S. Department of Health and Human Services and Centers for Medicare & Medicaid Services (CMS) following their suspension by federal officials. On the same day, the plaintiffs moved for emergency relief—a temporary restraining order (TRO) and preliminary injunction to block the suspension. The case has been assigned to Judge James E. Boasberg, an Obama appointee.
