On May 3, 2024, the United States Departments of Health & Human Services (HHS) released final regulations specifying that Deferred Action for Childhood Arrivals (DACA) recipients are eligible to enroll in coverage with financial assistance through a Health Insurance Marketplace (Marketplace) plan or Basic Health Plan (BHP). These regulations will be effective on November 1, 2024, in time for the next Affordable Care Act (ACA) Open Enrollment Period (OEP). DACA defers deportation for certain undocumented immigrants who came to the US as children.

The administration released its proposed regulations in April 2023, and received 583 comments from stakeholders during the public comment period. In response to those comments, the final regulations:
