ACA Litigation Round-Up: Part III

In April 2020, the Supreme Court issued a resounding ruling that insurers were entitled to more than $12.2 billion in unpaid risk corridors payments. Following the decision, the lower courts turned to resolving more than five dozen pending lawsuits—including two class actions—over these payments. Most lower courts granted a temporary delay, which the government requested to determine how it wanted to resolve the pending cases. Following that delay, many of those cases have already been, or will soon be, resolved. This post summarizes the latest on risk corridors litigation. Two prior posts on Affordable Care Act (ACA) litigation focused on other recent Supreme Court decisions and provided a status check on other pending ACA lawsuits.
